- Description: Wisconsin throws out any mailed ballot that arrives after 8 p.m. on Nov. 3. With USPS cutting pickups and a judge refusing a provisional-ballot fallback, state officials now say to mail by Oct. 20.

Wisconsin voters mailing absentee ballots for the Nov. 3 election have less room for error than voters in most states, and cost-cutting at the U.S. Postal Service has narrowed it further. State law requires a mailed ballot to reach the voter's municipal clerk by 8 p.m. on Election Day, and a ballot that shows up the next morning isn't counted, no matter when it was postmarked.1,2 This week a Dane County judge declined to let voters who fear a late delivery cast a provisional ballot at the polls as a backup, which leaves the timing of the mail, or a trip to a drop box or clerk's office, as the whole question.3

## Postmarks don't matter here. Transit time does.

Since April 2025, USPS has cut daily mail pickups and changed processing at some post offices, mostly rural ones, under what it calls Regional Transportation Optimization, part of a 10-year plan to steady its finances.4 One result is that a letter dropped in a blue box may not be postmarked the day it's collected, NPR reported Friday. That's a direct hazard in states that count ballots postmarked by Election Day. Brookings Institution senior fellow Elena Patel estimated that 43,000 to 55,000 more ballots nationwide could be rejected as late because of the changes, a figure she produced before USPS finalized its election plan.4 Starting Oct. 26, USPS says affected post offices will pull ballots out of the regular mail so managers can hand-postmark them the day they're collected.4

In Wisconsin, the postmark is beside the point. The Wisconsin Elections Commission's own guidance says the state doesn't use it, and Dane County Clerk Scott McDonell told reporters earlier this year that postmarks are irrelevant here.1,5 What counts is how many days the envelope spends in transit. In a July letter to Sen. Tammy Baldwin (D-Wis.), a USPS government liaison said the one-trip-a-day schedule adds hours, not days, to transport time. The Milwaukee Journal Sentinel reported that nearly 400 locations in the Wisconsin region were affected. The state's three regional processing plants are in Madison, Milwaukee and Green Bay.6

Voters have noticed. Confidence among Democrats that USPS would deliver mail ballots on time fell from 86% before the 2024 election to 60% in a Marist poll taken in September, while Republicans' confidence held steady, NBC News reported.7

## What the April election showed

Wisconsin's spring election was a preview. Of 906 clerks who answered a WEC survey afterward, about two-thirds said they saw problems with mail travel times, 39% called mail performance somewhat or much worse than in past elections, and only 3% reported positive feedback from voters.8 Clerks' written comments blamed routing through processing centers in Milwaukee or Minneapolis, slow out-of-state mail and request deadlines they considered unrealistic.8

The counts of uncounted ballots vary by source. Milwaukee election chief Paulina Gutiérrez told Votebeat the city received more than 269 late ballots the day after the election, while the League of Women Voters of Wisconsin put Milwaukee's figure at 336, all rejected.2,3 Madison and Fond du Lac each received more than 100 ballots too late to count, according to the same reports.2,3

## The deadline keeps moving earlier

For years, USPS and WEC told Wisconsin voters a week was enough. WEC's July 16 guidance raised that to at least 10 days and warned that mailing a ballot the week before Election Day carries "a significant risk" it won't be counted.1 In September, the Wisconsin Examiner reported that WEC Administrator Meagan Wolfe had moved the recommendation to 14 days, which puts the mail-by date at Oct. 20.9

Some clerks want even more cushion. Marathon County Clerk Kim Trueblood told the Journal Sentinel she'd suggest more than 10 days for rural voters, and Fond du Lac Clerk Margaret Hefter called the state's request deadline misleading because the mail can't complete a round trip in that time.10 Under state law, a voter can still request an absentee ballot until 5 p.m. on the Thursday before the election, which this year is Oct. 29.1

## The lawsuit that didn't change the rules

State law bars anyone who has mailed or delivered an absentee ballot from voting again in person on Election Day.2 In July, the League of Women Voters of Wisconsin and a Dane County voter sued WEC over its guidance applying that rule, arguing that voters worried about the mail should be able to cast a provisional ballot that would count only if their absentee ballot arrived late.2,3

At a hearing this week, the Dane County judge denied a temporary injunction, Democracy Docket reported Thursday. The league can still pursue summary judgment, but a ruling would likely land after Nov. 3.3 Republican state Rep. Calvin Callahan intervened in the case to defend the law. "One person, one ballot," he said in a statement.3

## How to get a ballot back in Green Bay

Green Bay mails absentee ballots postage-paid both ways, but the city also takes them by hand. Completed ballots can go in the drop box outside City Hall at 100 N. Jefferson St. or to the clerk's office inside until 8 p.m. on Election Day.11 Early in-person absentee voting opens statewide Oct. 20, and municipal clerks post their own hours and sites.9 Voters can check whether a returned ballot has been received at MyVote.wi.gov.11

A voter who has an absentee ballot but hasn't sent it back can still vote at the polls on Nov. 3, according to the city clerk's office. Poll workers will see that a ballot was issued, and the voter should destroy the unused one at home.11
